What is Category 2 status?

Category 2 is Gibraltar's residency regime for high-net-worth individuals. Rather than paying tax on the whole of their income, a Category 2 resident is taxed only on a capped band of assessable income each year — so there is a fixed minimum and a fixed maximum amount of tax payable, regardless of how much they actually earn worldwide. For internationally mobile individuals leaving a higher-tax country, it provides both a predictable tax bill and clear evidence of being tax resident in Gibraltar.

Who Category 2 suits

The regime is designed for individuals with substantial personal wealth who want to base themselves in a stable, English-speaking, low-tax jurisdiction without committing to running a business locally. It is popular with entrepreneurs who have realised an exit, investors living off portfolio income, and families relocating for lifestyle and succession-planning reasons.

Qualifying criteria

To be granted Category 2 status you must satisfy two core requirements:

  • Net wealth: assets — which can include property, shares and investments — in excess of £5 million.
  • Approved accommodation: residential property in Gibraltar, approved by the Finance Centre Director, available for your exclusive use, secured by purchase or rental within the required window after approval.

You will also confirm whether you intend to carry on business from Gibraltar; this is permitted with approval, provided it does not compete with similar local businesses.

How the tax cap works

Category 2 tax is charged on a capped band of income, so your liability sits between a fixed minimum and maximum each year:

  • Minimum annual tax: [VERIFY: current minimum]

The exact figure depends on your income within the assessable band. A guarantee deposit of [VERIFY: current deposit] is payable on approval and refunded when you relinquish the status, provided no tax is outstanding. The tax year runs 1 July to 30 June, with an annual return filed locally.

The application process

  1. Evidence of net wealth above £5 million (bank statements, portfolio valuations, or an accountant's letter; valuations or surveyor's reports for property and other assets).
  2. A character reference from a bank, plus a second from a lawyer, accountant or further bank.
  3. A CV setting out your source of wealth.
  4. The Government application form (we provide it) with the non-refundable application fee of [VERIFY: current fee].

You may choose a start date for the status from the date of application or later.

Spouses and children

A spouse and children (under 18, or in full-time education) can be included on the same Category 2 certificate as the principal applicant. A spouse may also elect to have their income treated as part of the applicant's and declared on the same return.

Civilian Registration Card & residence permit

Once suitable accommodation is secured, you and your family can apply for a Gibraltar Civilian Registration Card, issued alongside a residence permit, which evidences your residence. Private medical insurance covering all risks in Gibraltar and the neighbouring Spanish hinterland is required for each family member.
